Terms and conditions of Dailycup.pl store
§ 1 Preliminary provisions
- The online store operating at dailycup.pl is owned by Daily Cup Coffee Mateusz Dajlidzionek registered at Prusinowice 103, 95-083 Prusinowice, NIP no.: 1181938904, REGON no.: 521857208.
- The user is obliged to read the Terms and Conditions before using the Store.
- These Regulations are addressed both to all users of the Store and define the rules for the use of the Online Store and the principles and procedure for concluding Distance Sales Agreements with the Customer through the Store.
§ 2 Regulatory definitions
- Store - an online store operated by the Seller at the following web address dailycup.pl
- Consumer - a natural person, as well as a legal person and an organizational unit that is not a legal person, to which special regulations grant legal capacity, and who performs or intends to conclude a contract or use other services offered through the site.
- Seller - Daily Cup Coffee Mateusz Dajlidzionek, NIP No.: 1181938904, REGON No.: 521857208.
- Customer - a natural person making a legal transaction with the Seller that is not directly related to his business.
- Contract concluded at a distance - a contract concluded with a Customer within an organized system of concluding contracts at a distance (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.
- Product - a movable item/service available in the Store, which is the subject of a Sales Contract between the Customer and the Seller.
- Regulations - these rules and regulations of the Store.
- Order - the Customer's declaration of intent made via the Order Form and aimed directly at concluding a Sales Agreement for a Product or Products with the Seller.
- Account - a customer's account in the Store, it collects data provided by the Customer and information about the Orders placed by him/her in the Store.
- Registration form - a form available in the Store that allows you to create an Account.
- Order Form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
- Shopping Cart - an element of the Store's software, where the Products selected by the Customer for purchase are visible, and it is possible to determine and modify the Order data, in particular the quantity of products.
- Sales Contract - a contract of sale of a Product concluded or entered into between the Customer and the Seller via the Online Store. The Sales Agreement is also understood - applying to the characteristics of the Product - a contract for the provision of services and a contract for a work of art.
§ 3 Contact with the Store

§ 4 Technical requirements
- Do korzystania ze Sklepu, w tym przeglądania asortymentu Sklepu oraz składania zamówień na Produkty, niezbędne są:
- urządzenie końcowe z dostępem do sieci Internet i przeglądarką internetową,
- aktywne konto poczty elektronicznej (e-mail),
- włączona obsługa plików cookies,
- klawiaturę lub inne urządzenie wskazujące, umożliwiające poprawne wypełnienie formularzy elektronicznych.
§ 5 General information
- To the full extent described by the law, the Seller shall not be liable for disruptions including interruptions in the functioning of the Store caused by force majeure, unauthorized acts of third parties or incompatibility of the Online Store with the technical infrastructure of the Customer.
- Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Terms and Conditions or by providing the necessary personal and address data to allow the Order to be processed without creating an Account.

- The final (final) amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including charges for transportation, delivery and postal services), of which the Customer is informed on the pages of the Store during the placement of the Order, including at the moment of expressing the will to be bound by the Sales Contract.
- When the nature of the subject matter of the Contract does not allow, reasonably judging, to calculate in advance the amount of the final (definitive) price, information about how the price will be calculated, as well as fees for transportation, delivery, postal services and other costs, will be provided in the Store in the description of the Product
§ 6 Creating an Account in the Store
- In order to create an Account in the Store, you need to complete the Registration Form. It is necessary to provide the following email address. After providing it, you will be sent a message with a link to log in and set the account password.
- Creating an Account in the Store is free of charge.
- Logging into the Account is done by entering the login and password established in the Registration Form.

§ 7 Rules for placing an Order
In order to place an Order, you must:
- Log in to the Store (if the account was previously created);
- select the Product that is the subject of the Order, and then click the "Add to cart" button (or equivalent);
- if you have chosen the option of placing an Order without registration - fill out the Order Form by entering the data of the recipient of the Order and the address to which the Product is to be delivered, select the form of payment and delivery (method of delivery of the Product), enter the data for the invoice (optional), comments to the order (optional),
- Select one of the available payment methods and depending on the payment method.
- Click the "Buy and pay" button and finalize the transaction.
§ 8 Delivery and payment methods offered

- Klient może skorzystać z następujących metod płatności:
- Płatność online za pomocą karty kredytowej,
- Płatność za pośrednictwem serwisu Przelewy24,
- Płatność mobilna Apple Pay, Google Pay,
- Detailed information about the costs and methods of delivery and acceptable methods of payment can be found on the pages of the Store.
§ 9 Performance of the sales contract
- The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order using the Order Form in the Online Store in accordance with § 7 of the Terms and Conditions.
- After the Order is placed, the Seller shall immediately confirm its receipt and simultaneously accept the Order for execution. Confirmation of receipt of the Order and its acceptance for execution is made by the Seller sending the Client an appropriate e-mail message to the Client's e-mail address provided during the placement of the Order, which contains at least the Seller's statements about receipt of the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. As soon as the Customer receives the above e-mail message, the Sales Agreement between the Customer and the Seller is concluded.
- At the time of ordering, the customer is obliged to make payment through the Order Form - otherwise the order will be canceled.
- If the Customer has chosen a method of delivery other than personal collection, the Product will be shipped by the Seller on the date indicated in its description (subject to paragraph 5 of this section).

- Po dokonaniu płatności oraz otrzymaniu zamówienia w Sklepie termin dostawy naliczany jest od dnia zaksięgowania wpłaty na rachunku bankowym Sprzedawcy.
- If the customer chooses personal pick-up, the customer will be informed by the seller about the readiness of the product for pick-up by sending an appropriate e-mail message to the customer's e-mail address provided during order placement.
- In case of ordering Products with different dates of readiness for collection, the Customer has the option to collect all Products after the entire order is completed, which will be informed in an e-mail.
- Początek biegu terminu gotowości Produktu do odbioru przez Klienta liczy się w następujący sposób:
- Po dokonaniu płatności oraz otrzymaniu zamówienia w Sklepie – od dnia uznania rachunku bankowego Sprzedawcy.
- Delivery of the Product takes place on the territory of Poland.
- Delivery of the Product to the Customer is chargeable, unless the Sales Contract provides otherwise. The Product's delivery costs (including transportation, delivery and postal fees) are indicated to the Customer on the pages of the Online Store under the "Delivery, Payment" tab and when placing the Order.
- Personal collection of the Product by the Customer is free of charge.
§ 10 Complaint and warranty
- The Sales Contract covers new Products.
- If there is a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the warranty provisions of the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.
- If the Product has a manufacturer's warranty, information about it will be included in the description of the Product in the Store.
- The rules for complaints are defined by the manufacturer's warranty - applies to products for which a manufacturer's warranty has been granted.
- Complaints should be submitted in writing or electronically to the Seller's addresses given in these Regulations.
- It is recommended to include in the complaint, among other things, a brief description of the defect, the circumstances (including the date) of its occurrence, the data of the customer making the complaint, and the customer's request in connection with the defect of the goods.
- The seller will respond to the complaint request immediately, no later than within 14 days.
- Goods sent back under the complaint procedure should be sent to the address specified in § 3 of these Regulations.
§ 11 Right of withdrawal
- The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
- The running of the period specified in paragraph 1 begins with the delivery of the Product to the Consumer or a person other than the carrier designated by the Consumer.
- The Consumer may withdraw from the Contract by submitting a statement of withdrawal from the Contract to the Seller. To meet the deadline for withdrawal from the Agreement it is sufficient for the Consumer to send the statement before the deadline.
- The statement should be sent electronically by sending the statement to the Seller's e-mail address - the Seller's contact details are specified in § 3.
- Skutki odstąpienia od Umowy:
- W przypadku odstąpienia od Umowy zawartej na odległość Umowę uważa się za niezawartą.
- W przypadku odstąpienia od Umowy Sprzedawca zwraca Konsumentowi niezwłocznie, nie później niż w terminie 14 dni od dnia otrzymania oświadczenia Konsumenta o odstąpieniu od Umowy, wszystkie dokonane przez niego płatności, w tym koszty dostarczenia rzeczy, z wyjątkiem dodatkowych kosztów wynikających z wybranego przez Konsumenta sposobu dostarczenia innego niż najtańszy zwykły sposób dostarczenia oferowany przez Sprzedawcę.
- Zwrotu płatności Sprzedawca dokona przy użyciu takich samych metod płatności, jakie zostały przez Konsumenta użyte w pierwotnej transakcji, chyba że Konsument wyraźnie zgodził się na inne rozwiązanie, które nie będzie się wiązało dla niego z żadnymi kosztami.
- Sprzedawca może wstrzymać się ze zwrotem płatności do czasu otrzymania Produktu z powrotem lub do czasu dostarczenia mu dowodu jego odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej.
- Konsument powinien odesłać Produkt na adres Sprzedawcy podany w niniejszym Regulaminie niezwłocznie, nie później niż 14 dni od dnia, w którym poinformował Sprzedawcę o odstąpieniu od Umowy. Termin zostanie zachowany, jeśli Konsument odeśle Produkt przed upływem terminu 14 dni.
- Konsument ponosi bezpośrednie koszty zwrotu Produktu, także koszty zwrotu Produktu, jeśli ze względu na swój charakter Produkt ten nie mógł zostać w zwykłym trybie odesłany pocztą.
- Konsument odpowiada tylko za zmniejszenie wartości Produktu wynikające z korzystania z niego w sposób inny niż było to konieczne do stwierdzenia charakteru, cech i funkcjonowania Produktu.
- If, due to the nature of the Product, it cannot be sent back in the usual way by mail, information about this, as well as about the cost of returning the Product, will be available by e-mail from the Store.
- Prawo do odstąpienia od umowy zawartej na odległość nie przysługuje Konsumentowi w odniesieniu do Umowy:
- w której przedmiotem świadczenia jest rzecz nieprefabrykowana, wyprodukowana według specyfikacji Konsumenta lub służąca zaspokojeniu jego zindywidualizowanych potrzeb,
- w której przedmiotem świadczenia jest rzecz dostarczana w zapieczętowanym opakowaniu, której po otwarciu opakowania nie można zwrócić ze względu na ochronę zdrowia lub ze względów higienicznych, jeżeli opakowanie zostało otwarte po dostarczeniu,
- w które przedmiotem świadczenia jest rzecz ulegająca szybkiemu zepsuciu lub mająca krótki termin przydatności do użycia,
- o świadczenie usług, jeżeli Sprzedawca wykonał w pełni usługę za wyraźną zgodą Konsumenta, który został poinformowany przez rozpoczęciem świadczenia, że po spełnieniu świadczenia przez Sprzedawcę utraci prawo odstąpienia od Umowy,
§ 12 Personal data in the Online Store
- The administrator of Customers' personal data collected through the Online Store is the Seller.
- Customers' personal data collected by the administrator through the Online Store are collected for the purpose of executing the Sales Agreement, and if the Customer agrees - also for marketing purposes.
- The principles of protection of personal data of customers of the Online Store are defined in the privacy policy.
- The customer has the right to access and correct the content of his data.
- Provision of personal data is voluntary, although failure to provide the personal data indicated in the Regulations that are necessary to conclude a Sales Agreement results in the inability to conclude such an agreement
§ 13 Out-of-court ways of dealing with complaints and claim investigation
- Detailed information on the consumer's ability to use out-of-court procedures for handling complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and websites of district (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Commercial Inspection and at the following web addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php;
http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php. - Konsument posiada następujące przykładowe możliwości skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń:
- Konsument uprawniony jest do zwrócenia się do stałego polubownego sądu konsumenckiego, o którym mowa w art. 37 ustawy z dnia 15 grudnia 2000 r. o Inspekcji Handlowej (Dz.U. z 2014 r. poz. 148 z późn. zm.), z wnioskiem o rozstrzygnięcie sporu wynikłego z Umowy zawartej ze Sprzedawcą.
- Konsument uprawniony jest do zwrócenia się do wojewódzkiego inspektora Inspekcji Handlowej, zgodnie z art. 36 ustawy z dnia 15 grudnia 2000 r. o Inspekcji Handlowej (Dz.U. z 2014 r. poz. 148 z późn. zm.), z wnioskiem o wszczęcie postępowania mediacyjnego w sprawie polubownego zakończenia sporu między Konsumentem a Sprzedawcą.
- Konsument może uzyskać bezpłatną pomoc w sprawie rozstrzygnięcia sporu między nim a Sprzedawcą, korzystając także z bezpłatnej pomocy powiatowego (miejskiego) rzecznika konsumentów lub organizacji społecznej, do której zadań statutowych należy ochrona konsumentów (m.in. Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich).
§ 14 Final provisions
- Contracts concluded through the Online Store are concluded in the Polish language.
- The Seller reserves the right to introduce and cancel offers, promotions and to change the prices of products in the Store without prejudice to the rights acquired by the Buyer, including in particular the terms of contracts concluded before the change. The Seller reserves the right to make changes to the Regulations. Contracts concluded before the change of the Terms and Conditions shall be governed by the Terms and Conditions in effect on the date of conclusion of the contract.
- Buyers who have an account in the Store of any change in the Terms and Conditions will be notified by e-mail to the e-mail address assigned to the account.
- The Seller informs consumers about the possibility of using out-of-court procedures for handling complaints and pursuing claims. The rules of access to these procedures are available at the offices or websites of entities authorized to handle disputes out of court. These may include, in particular, consumer ombudsmen or Provincial Inspectorates of Commercial Inspection, a list of which is available on the website of the Office of Competition and Consumer Protection. The Seller informs that at http://ec.europa.eu/consumers/odr the platform of the online system of dispute resolution between consumers and businesses at the EU level (ODR platform) is available. The Seller does not use the out-of-court dispute resolution referred to in the Law of September 23, 2016 on out-of-court resolution of consumer disputes.
