{"id":1036,"date":"2023-05-15T14:18:28","date_gmt":"2023-05-15T12:18:28","guid":{"rendered":"https:\/\/dailycup.pl\/?page_id=1036"},"modified":"2026-02-12T16:09:03","modified_gmt":"2026-02-12T15:09:03","slug":"regulamin","status":"publish","type":"page","link":"https:\/\/dailycup.pl\/en\/regulamin\/","title":{"rendered":"Terms and Conditions"},"content":{"rendered":"<div class=\"wp-block-stackable-spacer stk-block-spacer stk--no-padding stk-block stk-4bed3a9\" data-block-id=\"4bed3a9\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Terms and conditions of Dailycup.pl store<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 1 Preliminary provisions<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Sklep internetowy dzia\u0142aj\u0105cy pod adresem <a href=\"https:\/\/dailycup.pl\/en\/\" data-type=\"page\" data-id=\"626\">dailycup.pl<\/a> jest w\u0142asno\u015bci\u0105 Daily Collective sp. z o.o.<\/li>\n\n\n\n<li> zarejestrowan\u0105 pod adresem Prusinowice 103, 95-083 Prusinowice, nr NIP: 7312095617, nr REGON: 543851105.<\/li>\n\n\n\n<li>The user is obliged to read the Terms and Conditions before using the Store.<\/li>\n\n\n\n<li>These Regulations are addressed both to all users of the Store and define the rules for the use of the Online Store and the principles and procedure for concluding Distance Sales Agreements with the Customer through the Store.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 2 Regulatory definitions<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Store - an online store operated by the Seller at the following web address dailycup.pl<\/li>\n\n\n\n<li>Consumer - a natural person, as well as a legal person and an organizational unit that is not a legal person, to which special regulations grant legal capacity, and who performs or intends to conclude a contract or use other services offered through the site.<\/li>\n\n\n\n<li>Sprzedawca \u2013 Daily Collective sp. z o.o., nr NIP: 7312095617, nr REGON: 543851105.<\/li>\n\n\n\n<li>Customer - a natural person making a legal transaction with the Seller that is not directly related to his business.<\/li>\n\n\n\n<li>Contract concluded at a distance - a contract concluded with a Customer within an organized system of concluding contracts at a distance (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.<\/li>\n\n\n\n<li>Product - a movable item\/service available in the Store, which is the subject of a Sales Contract between the Customer and the Seller.<\/li>\n\n\n\n<li>Regulations - these rules and regulations of the Store.<\/li>\n\n\n\n<li>Order - the Customer's declaration of intent made via the Order Form and aimed directly at concluding a Sales Agreement for a Product or Products with the Seller.<\/li>\n\n\n\n<li>Account - a customer's account in the Store, it collects data provided by the Customer and information about the Orders placed by him\/her in the Store.<\/li>\n\n\n\n<li>Registration form - a form available in the Store that allows you to create an Account.<\/li>\n\n\n\n<li>Order Form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.<\/li>\n\n\n\n<li>Shopping Cart - an element of the Store's software, where the Products selected by the Customer for purchase are visible, and it is possible to determine and modify the Order data, in particular the quantity of products.<\/li>\n\n\n\n<li>Sales Contract - a contract of sale of a Product concluded or entered into between the Customer and the Seller via the Online Store. The Sales Agreement is also understood - applying to the characteristics of the Product - a contract for the provision of services and a contract for a work of art.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 3 Contact with the Store<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Adres Sprzedawcy: Daily Collective sp. z o.o., Prusinowice 103, 95-083 Prusinowice<\/li>\n\n\n\n<li class=\"translation-block\">Seller's email address: <a href=\"mailto:hello@dailycup.pl\" target=\"_self\">hello@dailycup.pl<\/a><\/li>\n\n\n\n<li>Numer rachunku bankowego Sprzedawcy: \u202d40 1140 2004 0000 3502 8643 5160<\/li>\n\n\n\n<li>The customer can communicate with the Seller using the email address provided in this paragraph or via chat on the website.<\/li>\n\n\n\n<li>The customer can communicate with the Seller by phone from 10:00 a.m. to 4:00 p.m.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 4 Technical requirements<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Do korzystania ze Sklepu, w tym przegl\u0105dania asortymentu Sklepu oraz sk\u0142adania zam\u00f3wie\u0144 na Produkty, niezb\u0119dne s\u0105:\n<ul class=\"wp-block-list\">\n<li>urz\u0105dzenie ko\u0144cowe z dost\u0119pem do sieci Internet i przegl\u0105dark\u0105 internetow\u0105,<\/li>\n\n\n\n<li>aktywne konto poczty elektronicznej (e-mail),<\/li>\n\n\n\n<li>w\u0142\u0105czona obs\u0142uga plik\u00f3w cookies,<\/li>\n\n\n\n<li>klawiatur\u0119 lub inne urz\u0105dzenie wskazuj\u0105ce, umo\u017cliwiaj\u0105ce poprawne wype\u0142nienie formularzy elektronicznych.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 5 General information<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>To the full extent described by the law, the Seller shall not be liable for disruptions including interruptions in the functioning of the Store caused by force majeure, unauthorized acts of third parties or incompatibility of the Online Store with the technical infrastructure of the Customer.<\/li>\n\n\n\n<li>Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an Account in accordance with the provisions of \u00a7 6 of the Terms and Conditions or by providing the necessary personal and address data to allow the Order to be processed without creating an Account.<\/li>\n\n\n\n<li>Ceny podane w Sklepie s\u0105 podane w polskich z\u0142otych i s\u0105 cenami brutto (uwzgl\u0119dniaj\u0105 podatek VAT).<\/li>\n\n\n\n<li>The final (final) amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including charges for transportation, delivery and postal services), of which the Customer is informed on the pages of the Store during the placement of the Order, including at the moment of expressing the will to be bound by the Sales Contract.<\/li>\n\n\n\n<li>When the nature of the subject matter of the Contract does not allow, reasonably judging, to calculate in advance the amount of the final (definitive) price, information about how the price will be calculated, as well as fees for transportation, delivery, postal services and other costs, will be provided in the Store in the description of the Product<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 6 Creating an Account in the Store<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>In order to create an Account in the Store, you need to complete the Registration Form. It is necessary to provide the following email address. Confirmation of receipt of the Order and its acceptance for execution is made by the Seller sending the Client an appropriate e-mail message to the Client's e-mail address provided during the placement of the Order, which contains at least the Seller's statements about receipt of the Order and its acceptance for execution and confirmation of the conclusion of the Sales Agreement. As soon as the Customer receives the above e-mail message, the Sales Agreement between the Customer and the Seller is concluded.<\/li>\n\n\n\n<li>At the time of ordering, the customer is obliged to make payment through the Order Form - otherwise the order will be canceled.<\/li>\n\n\n\n<li>If the Customer has chosen a method of delivery other than personal collection, the Product will be shipped by the Seller on the date indicated in its description (subject to paragraph 5 of this section).<\/li>\n\n\n\n<li>Pocz\u0105tek biegu terminu dostawy Produktu do Klienta liczy si\u0119 w nast\u0119puj\u0105cy spos\u00f3b:\n<ul class=\"wp-block-list\">\n<li>Po dokonaniu p\u0142atno\u015bci oraz otrzymaniu zam\u00f3wienia w Sklepie termin dostawy naliczany jest od dnia zaksi\u0119gowania wp\u0142aty na rachunku bankowym Sprzedawcy.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>If the customer chooses personal pick-up, the customer will be informed by the seller about the readiness of the product for pick-up by sending an appropriate e-mail message to the customer's e-mail address provided during order placement.<\/li>\n\n\n\n<li>In case of ordering Products with different dates of readiness for collection, the Customer has the option to collect all Products after the entire order is completed, which will be informed in an e-mail.<\/li>\n\n\n\n<li>Pocz\u0105tek biegu terminu gotowo\u015bci Produktu do odbioru przez Klienta liczy si\u0119 w nast\u0119puj\u0105cy spos\u00f3b:\n<ul class=\"wp-block-list\">\n<li>Po dokonaniu p\u0142atno\u015bci oraz otrzymaniu zam\u00f3wienia w Sklepie \u2013 od dnia uznania rachunku bankowego Sprzedawcy.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Delivery of the Product takes place on the territory of Poland.<\/li>\n\n\n\n<li>Delivery of the Product to the Customer is chargeable, unless the Sales Contract provides otherwise. The Product's delivery costs (including transportation, delivery and postal fees) are indicated to the Customer on the pages of the Online Store under the \"Delivery, Payment\" tab and when placing the Order.<\/li>\n\n\n\n<li>Personal collection of the Product by the Customer is free of charge.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 10 Complaint and warranty<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The Sales Contract covers new Products.<\/li>\n\n\n\n<li>If there is a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the warranty provisions of the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability under the warranty.<\/li>\n\n\n\n<li>If the Product has a manufacturer's warranty, information about it will be included in the description of the Product in the Store.<\/li>\n\n\n\n<li>The rules for complaints are defined by the manufacturer's warranty - applies to products for which a manufacturer's warranty has been granted.<\/li>\n\n\n\n<li>Complaints should be submitted in writing or electronically to the Seller's addresses given in these Regulations.<\/li>\n\n\n\n<li>It is recommended to include in the complaint, among other things, a brief description of the defect, the circumstances (including the date) of its occurrence, the data of the customer making the complaint, and the customer's request in connection with the defect of the goods.<\/li>\n\n\n\n<li>The seller will respond to the complaint request immediately, no later than within 14 days.<\/li>\n\n\n\n<li>Goods sent back under the complaint procedure should be sent to the address specified in \u00a7 3 of these Regulations.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 11 Right of withdrawal<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.<\/li>\n\n\n\n<li>The running of the period specified in paragraph 1 begins with the delivery of the Product to the Consumer or a person other than the carrier designated by the Consumer.<\/li>\n\n\n\n<li>The Consumer may withdraw from the Contract by submitting a statement of withdrawal from the Contract to the Seller. To meet the deadline for withdrawal from the Agreement it is sufficient for the Consumer to send the statement before the deadline.<\/li>\n\n\n\n<li>The statement should be sent electronically by sending the statement to the Seller's e-mail address - the Seller's contact details are specified in \u00a7 3.<\/li>\n\n\n\n<li>Skutki odst\u0105pienia od Umowy:\n<ul class=\"wp-block-list\">\n<li>W przypadku odst\u0105pienia od Umowy zawartej na odleg\u0142o\u015b\u0107 Umow\u0119 uwa\u017ca si\u0119 za niezawart\u0105.<\/li>\n\n\n\n<li>W przypadku odst\u0105pienia od Umowy Sprzedawca zwraca Konsumentowi niezw\u0142ocznie, nie p\u00f3\u017aniej ni\u017c w terminie 14 dni od dnia otrzymania o\u015bwiadczenia Konsumenta o odst\u0105pieniu od Umowy, wszystkie dokonane przez niego p\u0142atno\u015bci, w tym koszty dostarczenia rzeczy, z wyj\u0105tkiem dodatkowych koszt\u00f3w wynikaj\u0105cych z wybranego przez Konsumenta sposobu dostarczenia innego ni\u017c najta\u0144szy zwyk\u0142y spos\u00f3b dostarczenia oferowany przez Sprzedawc\u0119.<\/li>\n\n\n\n<li>Zwrotu p\u0142atno\u015bci Sprzedawca dokona przy u\u017cyciu takich samych metod p\u0142atno\u015bci, jakie zosta\u0142y przez Konsumenta u\u017cyte w pierwotnej transakcji, chyba \u017ce Konsument wyra\u017anie zgodzi\u0142 si\u0119 na inne rozwi\u0105zanie, kt\u00f3re nie b\u0119dzie si\u0119 wi\u0105za\u0142o dla niego z \u017cadnymi kosztami.<\/li>\n\n\n\n<li>Sprzedawca mo\u017ce wstrzyma\u0107 si\u0119 ze zwrotem p\u0142atno\u015bci do czasu otrzymania Produktu z powrotem lub do czasu dostarczenia mu dowodu jego odes\u0142ania, w zale\u017cno\u015bci od tego, kt\u00f3re zdarzenie nast\u0105pi wcze\u015bniej.<\/li>\n\n\n\n<li>Konsument powinien odes\u0142a\u0107 Produkt na adres Sprzedawcy podany w niniejszym Regulaminie niezw\u0142ocznie, nie p\u00f3\u017aniej ni\u017c 14 dni od dnia, w kt\u00f3rym poinformowa\u0142 Sprzedawc\u0119 o odst\u0105pieniu od Umowy. Termin zostanie zachowany, je\u015bli Konsument ode\u015ble Produkt przed up\u0142ywem terminu 14 dni.<\/li>\n\n\n\n<li>Konsument ponosi bezpo\u015brednie koszty zwrotu Produktu, tak\u017ce koszty zwrotu Produktu, je\u015bli ze wzgl\u0119du na sw\u00f3j charakter Produkt ten nie m\u00f3g\u0142 zosta\u0107 w zwyk\u0142ym trybie odes\u0142any poczt\u0105.<\/li>\n\n\n\n<li>Konsument odpowiada tylko za zmniejszenie warto\u015bci Produktu wynikaj\u0105ce z korzystania z niego w spos\u00f3b inny ni\u017c by\u0142o to konieczne do stwierdzenia charakteru, cech i funkcjonowania Produktu.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>If, due to the nature of the Product, it cannot be sent back in the usual way by mail, information about this, as well as about the cost of returning the Product, will be available by e-mail from the Store.<\/li>\n\n\n\n<li>Prawo do odst\u0105pienia od umowy zawartej na odleg\u0142o\u015b\u0107 nie przys\u0142uguje Konsumentowi w odniesieniu do Umowy:\n<ul class=\"wp-block-list\">\n<li>w kt\u00f3rej przedmiotem \u015bwiadczenia jest rzecz nieprefabrykowana, wyprodukowana wed\u0142ug specyfikacji Konsumenta lub s\u0142u\u017c\u0105ca zaspokojeniu jego zindywidualizowanych potrzeb,<\/li>\n\n\n\n<li>w kt\u00f3rej przedmiotem \u015bwiadczenia jest rzecz dostarczana w zapiecz\u0119towanym opakowaniu, kt\u00f3rej po otwarciu opakowania nie mo\u017cna zwr\u00f3ci\u0107 ze wzgl\u0119du na ochron\u0119 zdrowia lub ze wzgl\u0119d\u00f3w higienicznych, je\u017celi opakowanie zosta\u0142o otwarte po dostarczeniu,<\/li>\n\n\n\n<li>w kt\u00f3re przedmiotem \u015bwiadczenia jest rzecz ulegaj\u0105ca szybkiemu zepsuciu lub maj\u0105ca kr\u00f3tki termin przydatno\u015bci do u\u017cycia,<\/li>\n\n\n\n<li>o \u015bwiadczenie us\u0142ug, je\u017celi Sprzedawca wykona\u0142 w pe\u0142ni us\u0142ug\u0119 za wyra\u017an\u0105 zgod\u0105 Konsumenta, kt\u00f3ry zosta\u0142 poinformowany przez rozpocz\u0119ciem \u015bwiadczenia, \u017ce po spe\u0142nieniu \u015bwiadczenia przez Sprzedawc\u0119 utraci prawo odst\u0105pienia od Umowy,<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">\u00a7 12 Personal data in the Online Store<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The administrator of Customers' personal data collected through the Online Store is the Seller.<\/li>\n\n\n\n<li>Customers' personal data collected by the administrator through the Online Store are collected for the purpose of executing the Sales Agreement, and if the Customer agrees -
